Welcome to: HaYarkon 148 referred to in these Terms of Use as: "we," "us," "our." These terms will apply to all engagements for the purpose of consuming hospitality services in the building known as HaYarkon 148 in Tel Aviv operated by Kravitz LTD (hereinafter: "the Company" and "the Building").

These Terms of Use (hereinafter: "the Terms") apply to, among other things, your access to and use of our website and booking platform (hereinafter: "the Site") and our services (together hereinafter: "the Services"). By accessing or using the Site or Services, you acknowledge that you agree to be bound by these Terms. If you do not agree to the Terms, you must refrain from accessing or using the website or Services.

1. These Terms refer equally to both genders, and any use of masculine pronouns is for convenience only.
2. The provisions of these Terms and the terms of use listed on the Site define the legal relationship between the customer and the Site, the terms of use of the Site and / or the ordering of products from the Site, and indicate the customer's agreement to these terms and additional terms appearing on the Site.

12. The Consumption of Services is also for personal use only and not for any commercial purpose.
13. The Company is not responsible for any illegal activity that may be conducted, by any user of the Site, or any other party over whom it has no control.
14. The Company reserves the right to deny or terminate any user's access to any part of the Site without notice, and the user shall have no lawsuit, claim, or demand against the Company in this matter.
15. It is hereby clarified that entering false purchase details, including impersonation, is a criminal offense, and the Site must not be used for entering purchase details not intendent for purchase purposes, and the Company shall be entitled to take all measures available to it under law, against anyone who acts as stated, including claims for damages that may be caused to the Site, its operators and / or anyone on their behalf.

It is clarified that the Company may choose to reject, not upload to the Site, or hide from its Facebook and Instagram pages, any response and/or feedback and/or image and/or content (hereinafter: "the Content"), which, at its sole and absolute discretion, may harm the Company's reputation and/or anyone on its behalf and  /or public sentiment and  /or is of an offensive/suicidal nature or sexually or otherwise offensive and/or may cause violation of any property rights and/or contravenes any law and/or for any other reason.

Any user of the Services offered on the Site and the Company's social media pages, hereby declares and confirms that they grant the Company full and exclusive right to use the content they have uploaded, and authorize and commit that the Company may use their name and / or image, in any publication and / or display of the Content on the Site and / or social media without any payment.

Making a Reservation

18. To reserve a spot at one of our properties, you must complete our booking process, including providing your name, contact information, and payment details.

Advance Payment

19. To confirm your reservation, we require advance payment of the total cost of your stay (hereinafter: "the Consideration"). The Consideration amount or any part thereof is non-refundable unless otherwise agreed in writing by: _________.

Payment Methods

20. We accept payment by credit card, cash, or other payment methods we may make available on the Site at our sole discretion.
21. Cash payments are subject to the Cash Usage Reduction Law, 2018.

VAT

22. All prices shown on the Site are net prices for tourists. Israeli citizens must add VAT to the service cost at the rate determined by law at the time of payment.

Cancellation

23. The customer may cancel the transaction in accordance with the Consumer Protection Law and its regulations. Without derogating from the above:

23.1. The transaction may be canceled within 14 days from the transaction date (the transaction day itself is not counted), provided that until the occupancy date there are more than 7 non-rest days (the occupancy date is not counted).

23.2. After receiving the cancellation notice, and subject to the above, the amount paid will be refunded minus a cancellation fee of 5% of the transaction amount or 100 NIS, whichever is lower.

24. A guest who is a person with disabilities as defined in the Equal Rights for Persons with Disabilities Law, 1998, a senior citizen (aged 65 or over), or a new immigrant (who has not completed five years since receiving their immigrant certificate or eligibility certificate from the Ministry of Immigration and Absorption), may cancel the reservation under all the following conditions:

·       The cancellation is made within four months of the transaction date or receipt of transaction details document, whichever is later, provided that the transaction included communication between the business and consumer, including electronic communication, and provided more than 7 non-rest days remain until the accommodation date.

·       If cancellation is made by a guest belonging to one of the populations listed in this section, the guest shall attach to the cancellation notice proof (through one of the means mentioned above) of belonging to one of the above populations, as detailed in the Consumer Protection Law.

·       If cancellation is made according to the cancellation terms mentioned in this chapter, the guest will be charged a cancellation fee of NIS 100 (one hundred) or 5% (five percent) of the reservation value, whichever is lower.

Cancellation by the Company

25. The Company shall be entitled, at its sole discretion, for any reason, and at any time, to cancel or terminate a reservation, in whole or in part, and/or the Site's activity, in whole or in part.
26. Notice of cancellation or termination will be provided to the user or customer, and the Company will refrain from charging the customer's credit card or will refund any amount paid to it if paid.
27. If the Company cancels the transaction, it will not be liable for and will not bear any direct, indirect, consequential, or special damage caused to the customer or third party, including but not limited to damage due to ordering the service from a third party at a higher price.

Check-in

28. Check-in time is 3:00 PM. If you wish to arrive earlier, please contact us and notify us in advance (early check-in is possible subject to availability and in any case according to the Company's sole discretion).

Check-out

29. Check-out time is 11:00 AM. If you wish to leave later, please contact us in advance (late check-out is possible subject to availability and in any case according to the Company's sole discretion). Late check-out may incur additional charges.

Cleaning

30. A cleaning fee is included in your booking. Additional cleaning services are available for an additional fee.

Prices

31. Prices for our properties may change at any time without prior notice. The price for your reservation will be confirmed and valid only at the time of booking.

Damages

32. During your stay, you bear full responsibility for any damage caused to our property. We reserve the right to charge your credit card for any damage you or your guests caused during the stay period.

Liability

33. The Company is not responsible for personal injuries, property damage, or other losses that may occur during your stay. You agree to use our properties and services at your own risk.

Terms of Use

34. You agree to use the website and consume our services in accordance with these terms and all relevant legal provisions.

Compensation

35. You agree to indemnify the Company for any damage, liability, or expenses (including reasonable attorney fees) arising from your use of the website or services, violation of these Terms, or breach of applicable laws and regulations.

ברוכים הבאים להירקון 148 (להלן: “האתר”). האתר מופעל ע”י קרביץ בע"מ (להלן: “הנהלת האתר” או “החברה”).
האתר משמש אתר סחר אלקטרוני אשר מציע, (בין היתר) למכירה מוצרים שונים (להלן: “המוצרים”).

1.      כללי

1.      האמור בתקנון זה מתייחס באופן שווה לבני שני המינים, והשימוש בלשון זכר הוא מטעמי נוחות בלבד.

2.      הוראות תקנון זה ותנאי השימוש המופיעים באתר מגדירים את מערכת היחסים המשפטית בין המזמין לבין האתר, את תנאי השימוש באתר ו/או
את הזמנת המוצרים מן האתר ומעידים על הסכמת המזמין, לתנאים אלה ולתנאים נוספים המופיעים באתר.

3.      החברה רשאית בכל עת, על פי שיקול דעתה הבלעדי, לעדכן  תקנון זה.

4.      תנאים אלה חלים על השימוש באתר ובשירותים הכלולים בו באמצעות כל מחשב או מכשיר תקשורת אחר (כדוגמת טלפון סלולארי, טבלטים למיניהם וכו’) כמו כן

5.      אין באמור בתקנון זה כדי לגרוע מהוראות חוק הגנת הצרכן, התשמ”א-1981 (להלן: “חוק הגנת הצרכן”) והתקנות אשר הותקנו מכוחו, ככל שהן חלות על האתר
(להלן: “ההוראות”), למעט במקרים בהם ניתן להתנות על הוראות כאמור והתניה כאמור בוצעה במסגרת האתר אם במפורש ואם במשתמע.

6.      החברה והנהלת האתר עושים כמיטב יכולתם להציג את המידע השלם והמקיף ביותר לגבי המוצר לרבות תמונות, חרף האמור בסעיף זה יובהר, כי עלולים
להופיע באתר בתום לב וללא כוונת זדון ו/או מתוך רצון להטעות, אי דיוקים ו/או שגיאות ו/או השמטות והחברה, הנהלת האתר והאתר לא יישאו באחריות כלשהי הנובעת
מאי הדיוקים ו/או או השגיאות.

7.      כותרות הפרקים מובאות לשם נוחות והתמצאות המזמין ולא ישמשו בפרשנות התקנון.

8.      טעות סופר בתיאור מוצר/ים לא תחייב את החברה.

9.      תמונות המוצרים באתר מוצגות לצורכי המחשה בלבד. בנוסף, ייתכנו הבדלים במראה, בגוון, בגודל, וכיו”ב בין המוצר, כפי שהוא מוצג באתר, לבין המוצר במציאות.

10.   אין להעתיק ולהשתמש, או לאפשר לאחרים להשתמש, בכל דרך אחרת בתכנים מתוך האתר, לרבות באתרי אינטרנט אחרים, בפרסומים אלקטרוניים,
בפרסומי דפוס וכיו”ב, לכל מטרה אחרת.

11.   המועד שנרשם, לכל עניין ועניין, במחשבי החברה הוא המועד הקובע לכל דבר.

 

 

2.      הרשמה לאתר

1.      על מנת לבצע הזמנה של מוצרים על המזמין להירשם באתר  באמצעות טופס הרשמה מקוון.

2.      כל אדם, לרבות חברה, רשאי להשתמש באתר, לרבות לבצע רכישות באמצעות האתר, בין היתר, בכפוף להיותו כשיר לבצע פעולות משפטיות מחייבות,
, בעל כרטיס אשראי  תקף ,שהונפק  ע”י אחת מחברות כרטיסי האשראי (לעיל ולהלן: “המזמין”).

3.      הרישום הינו חד פעמי, כאשר לאחריו המזמין לא יידרש לשוב ולהירשם בכל פעם מחדש בעת ביצוע הרכישה.

4.      בעת הרישום באתר על המזמין להזין שם משתמש וסיסמא וכן את כתובת הדואר האלקטרוני שלו. במידה וישכח המזמין את הסיסמא, תשלח אליו הסיסמא
הקיימת כפי שהוזנה בעת הרישום הראשוני באתר לכתובת הדוא”ל אשר הוזנה באתר.

5.      בעתיד אם וכאשר יבקש המזמין לרכוש מוצרים נוספים, יזוהה המזמין לפי שם המזמין והסיסמא שבחר.

6.      פרטי המזמין יעודכנו בהתאם לנתונים אשר ימולאו על ידי המזמין בטופס הרישום המקוון במצוי באתר.

7.      הנהלת האתר רשאית מעת לעת לדרוש פרטי זיהוי נוספים.

8.      מבלי לגרוע מהאמור לעיל, החברה תהא רשאית למנוע מכל אדם להשתמש באתר, באופן זמני או לצמיתות על פי שיקול דעתה הבלעדי ומבלי למסור
הודעה על כך מראש, לרבות בכל אחד מהמקרים הבאים:

1.      ביצוע מעשה בלתי חוקי ו/או הפרת הוראות הדין;

2.      הפרת תנאי מתנאי תקנון זה;

3.      מסירת פרטים שגויים במתכוון;

4.      ביצוע פעולה העלולה לפגוע בפעילותו התקינה של האתר ו/או במי מהספקים ו/או בצד ג’ כלשהו;

5.      כרטיס האשראי שברשות המזמין נחסם או הוגבל לשימוש בדרך כלשהי.

 

3.      רכישת מוצרים באתר

1.      רכישת המוצרים תתבצע באמצעות הוספת מוצרים לסל הקניות, לאחר הוספת מוצרים לסל הקניות יזין המזמין בטופס המקוון המיועד לכך בתהליך
ההזמנה את פרטי המזמין הבאים: שם פרטי, שם משפחה, מס’ טלפון, כתובת דואר אלקטרוני, בנוסף יש למסור את פרטי מקבל ההזמנה, שם פרטי,
שם משפחה, מס’ טלפון, יישוב, רחוב  מס’ בית, קומה, דירה, כניסה וכל פרט מזהה אחר שיש בידיו לסייע למבצע המשלוח לאתר בקלות את הנכס אליו מתבצעת
מסירת ההזמנה לרבות הערות ומידע בנוגע לפעולת השילוח ו/או במידה ומקבל ההזמנה אינו בבית. השדות המסומנים בכוכבית קיימת חובה למלאם ובלעדיהם לא תתאפשר
השלמת ההזמנה.

2.      על מנת למנוע כל אפשרות של תקלה במשלוח על המזמין למסור רק פרטים מדויקים ונכונים.

3.      בעת פעולת השלמת ההזמנה יאשר המזמין את פרטי ההזמנה ואת נכונות הפרטים שמסר.

4.      מילוי כל הפרטים מהווה תנאי מוקדם לביצוע ההזמנה וזאת לשם ביצוע ההזמנה ביעילות וללא תקלות ועל כן יש להקפיד על מסירת כל הפרטים במדויק.

5.      פרטי המזמין יעודכנו בהתאם לאמור בטופס ההזמנה המקוון באתר.

6.      מילוי כל הפרטים הנדרשים לרכישת המוצר על ידי המזמין יחשב לביצוע הזמנה (להלן:”ההזמנה”) עם קבלת ההזמנה, האתר יבצע בדיקה של פרטי כרטיס האשראי
ורק לאחר אישור חברת האשראי ו/או לאחר קבלת אישור מפיי פאל כפי שיובהר להלן, הפעולה תאושר ויצא אישור סופי של ההזמנה, חיוב הלקוח עבור המוצר יבוצע
דרך כרטיס האשראי ו/או דרך חשבון הפיי פאל כפי שיבואר להלן והכל בכפוף להימצאות המוצרים במלאי החברה והאתר.

7.      הפרטים כפי שהוזנו בטופס ההזמנה על ידי המזמין, יהוו ראיה חלוטה לנכונות הפעולות.

4.     
אופן ביצוע התשלום עבור ההזמנה

1.      התשלום עבור המוצרים יעשה באמצעות כרטיס אשראי או באמצעות חשבון בשירות “ארנק אלקטרוני” כדוגמת  פיי פאל- (WWW.PAYPAL.COM) וכל שירות דומה
, כפי שיהיה זמין לשימוש באתר, מעת לעת לפי שיקול דעתה של הנהלת האתר.

2.      אם יבחר המזמין להשתמש בכרטיס אשראי לשם ביצוע התשלום, יתבקש המזמין למסור את פרטי כרטיס האשראי, תעודת זהות, סוג הכרטיס ותוקפו. אם החליט המזמין לשלם באמצעות הפיי פאל, החברה תוכל לגבות את התשלום עבור המוצרים רק לאחר קבלת אישור מפיי פאל. השימוש וקבלת האישור מפיי-פאל כפופים לתנאי השימוש של אתר פיי פאל.

3.      הנהלת האתר שומרת לעצמה את הזכות להפסיק את השימוש באמצעי התשלום כלשהו באתר, להתיר שימוש באמצעי תשלום נוספים ולהחיל הסדרי תשלום שונים על סוגי כרטיסי אשראי שונים או אמצעי תשלום שהנהלת האתר תכבד.

4.      לאחר שהוזנו פרטי התשלום בטופס ההזמנה המקוון, ישלח אל המזמין אישור באמצעות הדואר האלקטרוני על קליטת פרטי ההזמנה. יובהר כי אישור זה אינו מחייב את הנהלת האתר לספק את המוצרים שהוזמנו והוא רק מעיד שפרטי ההזמנה נקלטו בהנהלת האתר.

5.      מיד לאחר ביצוע ההזמנה, תבצע הנהלת האתר בדיקה של אמצעי התשלום בו השתמש המזמין, תינתן הודעה מתאימה למזמין כי ההזמנה אושרה וחשבונו יחויב בעלות השירות.

6.      במקרה בו לא אושרה  העסקה על ידי חברת האשראי או על ידי חשבון הפיי פאל או כל אמצעי תשלום אר שיהיה באותה עת, יקבל המזמין הודעה מתאימה על כך והנהלת האתר תיצור קשר עם המזמין לשם השלמת העסקה או ביטולה.

7.      אישור פעולת הרכישה מותנה בהימצאות המוצר הנרכש במלאי במועד האספקה המבוקש ו/במועד ההזמנה. אם לא צויין, כי המוצר אינו קיים במלאי והמוצר לא הורד מהאתר עד למועד ביצוע ההזמנה, לא תהא הנהלת האתר מחויבת בכפוף לכך שהנהלת האתר תשיב למזמין כל סכום ששולם אם שולם להנהלת האתר ו/או תבטל את החיוב אם בוצע בגין פעולת הרכישה.

8.      יובהר כי יתכנו מצבים בהם על אף שהפריט מוצג באתר כקיים במלאי, בפועל הוא חסר  ולא ניתן לספק אותו, במקרים אלו תבוטל העסקה ולמזמין לא תהה כל טענה בקשר לכך בכפוף להשבת הסכום ששולם על ידי הלקוח.

9.      מועד המשלוח יקבע החל מיום אישור העסקה על ידי חברת האשראי או אישור מחשבון הפיי פאל  או שירות ארנק אלקטרוני זמין אחר שאושר.

10.   במידה והמזמין חויב בטעות על ידי חברת האשראי, על המזמין להודיע להנהלת האתר על מנת לבצע זיכוי בהתאם.

 

5.      אספקה והובלת המוצרים

1.      אספקת המוצר ע”י האתר יעשה רק לאחר קבלת אישור תשלום מאת חברת האשראי ו/או מאת חשבון הפיי פאל, כלומר המוצר שולם, כמפורט לעיל, המוצר יסופק לכתובת שהמזמין הקליד ו/או מסר בעת ביצוע ההזמנה בטופס המקוון.

2.      האתר מתחייב לספק את הסחורה במסגרת זמן האספקה ליעד המבוקש ויעשה כמיטב יכולתו כי המוצר יגיע במהירות.

3.      הנהלת האתר תפעל כמיטב יכולתה לספק את המוצרים במהירות והמוצרים ובתוך 14 ימי עסקים מיום קליטת ההזמנה ואישורה אם נשלח באמצעות דואר רשום ותוך 3 ימי עסקים אם נשלח באמצעות שליח.  
זמני אספקת המוצרים כוללים רק את חישובם של ימי עסקים (ימי א’ עד ה’, לא כולל ימי שישי, שבת, ערבי חג וימי חג).

4.      המשלוחים שיסופקו באמצעות חברת המשלוחים מטעם הנהלת האתר הינם בהתאם לתנאי חברת המשלוחים, אזורי החלוקה של חברת המשלוחים ובתאום מראש עם מקבל ההזמנה.

5.      במידה ואין ביכולתה של חברת המשלוחים לבצע את המשלוח עד לכתובת המשלוח מכל סיבה שהיא. הנהלת האתר תודיע למזמין ותפעל למציאת פתרון חלופי אשר יענה לרצון שני הצדדים.

6.      במקרים בהם מסופקים המוצרים באמצעות דואר ישראל, לכתובת המשלוח שמסר המזמין בעת ביצוע ההזמנה. המוצרים יישלחו בכפוף לזמן האספקה של דואר ישראל ואינם ניתנים לבקרה ולשליטה על ידי הנהלת האתר ו/או הספקים.

7.      מועדי האספקה המצוינים באתר ולעיל אינם חלים על מוצרים שאזלו מן המלאי של האתר ו/או מן המלאי של הספק הרלוונטי.

8.      המשלוחים מבוצעים על ידי חברת שליחויות, באמצעותה תבוצע ההובלה של המוצרים תנאי חברת השליחויות  יחייבו את הלקוח.

9.      דמי המשלוח – בנוסף למחיר המוצרים שהוזמנו, יושת על המזמין תשלום של דמי משלוח, סכום דמי המשלוח יופיע בתום תהליך ההזמנה בהתאם לדרך השילוח אותה בחר המזמין, אלא אם כן צויין אחרת.

10.   דמי המשלוח ישולמו עם התשלום בגין המוצר. במכירה בתשלומים באמצעות בכרטיס אשראי ו/או באמצעות חשבון הפיי פאל. האתר רשאי לגבות את דמי המשלוח עם חיוב התשלום הראשון.

11.   האתר לא יהיה אחראי לכל איחור ו/או עיכוב באספקה ו/או לאי אספקה של המוצרים אשר נגרם כתוצאה מאחת הסיבות להלן:

1.      כח עליון ומבלי לפגוע בכלליות האמור מלחמה, מבצע צבאי, מבצע חרום ו/או נזקי טבע ו/או מאירועים שאינם בשליטת האתר כגון שביתות והשבתות כלל משקיות ו/או אצל ספקים של שירותים או סחורות הדרושים לייצור אספקה או הובלת מוצר.

2.      כל סיבה שאינה בשליטת האתר ו/או החברה.

3.      מסיבה הקשורה עם מבצע השליחות.

12.   זמני אספקת המוצרים המצוינים כוללים רק את חישובם של ימי עסקים (ימי א’ עד ה’ לא כולל ימי שישי ושבת, ערבי חג וימי חג).

13.   על הלקוח להודיע מיידית לאתר אם המוצר לא סופק בתקופת האספקה המפורטת באתר, במקרה כזה זמן האספקה החדש ייחשב מיום תיאום מועד חדש.

14.   יש להקפיד למלא פרטים מדויקים ועדכניים, במקרה שהמוצרים יחזרו לחברה בגלל פרטים מוטעים, המזמין יישא בתשלום בגין דמי משלוח וטיפול. 

6.      ביטול רכישה מצד המזמין

1.      המזמין רשאי לבטל את העסקה בהתאם להוראות חוק הגנת הצרכן והתקנות שהותקנו על פיו. מבלי לגרוע מהאמור:

1.      ביטול ייעשה אך ורק בהודעה בכתב לכתובת הדוא”ל ………

2.      ביטול עסקה ע”י המזמין לא יתאפשר ברכישת פריטים מסוימים כמפורט בסעיף קטן 14ג(ד) לחוק הגנת הצרכן.

3.      ביטול העסקה ע”י הלקוח כפוף לכך שהמוצר יוחזר ככל שהדבר סביר או אפשרי באריזתו המקורית.

4.      לאחר קבלת הודעת הביטול יושב למזמין הסכום ששולם על ידו בגין המוצר בניכוי דמי ביטול (דמי המשלוח אינם חלק ממחיר המוצר ולכן ינוכו בנפרד מההחזר) בשיעור של 5% מסכום העסקה או 100 ש”ח, לפי הנמוך. במקרה של ביטול עסקה עקב פגם או אי התאמה, לא יחויב המזמין בדמי ביטול כלשהם. הוראות חוק הגנת הצרכן נוספות בנוגע לביטול הרכישה מצד המזמין, לרבות בנוגע לחובה להחזיר המוצר, יחולו גם-כן.

 

5. ביטול רכישה מצד החברה
1. החברה תהא רשאית, על פי שיקול דעתה הבלעדי, בשל כל סיבה, ובכל עת, לבטל או להפסיק עסקה ו/או מכירה ו/או לבטל הזמנה, כולה או חלקה, ו/או את פעילות האתר, כולו או חלקו.
2. הודעה על ביטול או הפסקה מעין זה תימסר למשתמש או למזמין, והחברה תימנע מחיוב כרטיס האשראי של המזמין או תשיב לו כל סכום ששולם בגין המוצרים, ככל ששולם.
3. למעט בגין השבת סכום העסקה כאמור, לא תהיה למשתמש או למזמין כל טענה, תביעה ו/או דרישה כלפי החברה ו/או הספק בגין ביטול העסקה כאמור בסעיף זה.
4. במידה והתגלה כי מוצר אזל מהמלאי, רשאי האתר לבטל את ההזמנה או להציע פריט חלופי שווה ערך. בוטלה הזמנה כאמור האתר לא יהיה אחראי ולא ישא בכל נזק ישיר, עקיף, תוצאתי או מיוחד שנגרם ללקוח או לצד שלישי לרבות אך לא רק נזק בגין רכישת הפריט אצל צד שלישי במחיר גבוה יותר.
6.  זכויות יוצרים
1. כל זכויות הקניין הרוחני, לרבות פטנטים, זכויות היוצרים, הדגמים, המדגמים והסודות המסחריים, הנם רכושם של החברה בלבד או של צדדים שלישיים אחרים שהרשו להנהלת האתר להשתמש בהם.
2. זכויות אלה חלות בין השאר על הנתונים באתר, לרבות רשימת המוצרים, תאור ועיצוב המוצרים וכל פרט אחר הקשור להפעלתו.
3. זכויות אלה חלות גם על שם האתר ושם המתחם (www.—–.com ) של האתר, סימני המסחר (בין אם נרשמו ובין אם לא) הם כולם רכושה של החברה. אין לעשות בהם שימוש בלא קבלת הסכמתה בכתב ומראש.
4. אין להעתיק, לשכפל, להפיץ, למכור, לשווק, להשכיר ולתרגם מידע כלשהו מהאתר, לרבות סימני מסחר, תמונות וטקסטים, עיצוב המוצרים תמונות המוצרים וכיו”ב בלא קבלת אישור מראש ובכתב של החברה.

5. אין לקשר לתכנים מהאתר, שאינם דף הבית של האתר (קישור עמוק) ואין להציג או לפרסם תכנים כאמור בכל דרך שהיא, אלא אם הקישור העמוק יהיה לדף האינטרנט באתר במלוא וכפי שהוא, כך שניתן יהיה לצפות ולהשתמש בו באופן הזהה לחלוטין לשימוש ולצפייה בו באתר  וזאת תוך קבלת ההסכמה מהנהלת האתר.
6. הנהלת האתר רשאית להורות על ביטול של קישור עמוק גם לאחר מתן הסכמתה וזאת לפי שיקול דעתה הבלעדי ובמקרב זה לא תהיה לך כל טענה ו/או דרישה ו/או תביעה כלפי הנהלת האתר.

9.      אחריות

10.   החברה (ו/או מי מטעמה) אינה נושאת במישרין ו/או בעקיפין באחריות כלשהי לנזקים הנובעים ו/או הקשורים בכל דרך שהיא, על תיקונם, הרכבתם ו/או החלפתם של המוצרים.

11.   החברה (ו/או מי מטעמה) אינה נושאת במישרין או בעקיפין באחריות כלשהי לנזקים הנובעים כתוצאה משימוש ו/או הסתמכות על מידע המתפרסם באתרים חיצוניים, שאליהם ניתן להגיע באמצעות איזה מהשירותים באתר. יובהר כי החברה עושה ותעשה כמיטב יכולתה לשתף פעולה עם ספקים אמינים ובעלי מוניטין בלבד.

12.   החברה (ו/או מי מטעמה) אינה נושאת במישרין ו/או בעקיפין באחריות כלשהי לנזקים הנובעים ו/או הקשורים בכל דרך שהיא בשימוש ו/או בביצועי האתר.

13.   בכל מקרה החברה לא תישא באחריות לפעילות כלשהי של כל גורם אחר שאינו בשליטתה המלאה.

 

10.   סודיות ופרטיות

1.      כל פרטיו האישים של המזמין (שם, דואר אלקטרוני וכדומה), יישמרו במאגרי המידע של החברה.

2.      החברה לא תעביר פרטיו האישיים של המזמין לאף גורם אחר זולת לספקים, במידת הצורך וזאת רק לשם השלמת עסקה.

3.      החברה לא תעשה כל שימוש בפרטים של אמצעי התשלום של המזמין אלא לביצוע תשלום בגין עסקה אותה ביקש המזמין לערוך, ופרטים אלו לא יועברו לאף גורם אחר זולת לצורך זה. למען הסר ספק, פרטי אמצעי התשלום אינם נשמרים במאגרי המידע של החברה.

4.      למרות האמור לעיל, החברה תהא רשאית להעביר פרטיו האישיים של משתמש לצד שלישי במקרים בהם המזמין ביצע מעשה או מחדל הפוגעים ו/או העלולים לפגוע בחברה ו/או בצדדים שלישיים כלשהם, המזמין עשה שימוש בשירותי החברה לביצוע מעשה בלתי חוקי, אם התקבל בידי החברה צו שיפוטי המורה לה למסור את פרטי המזמין לצד שלישי וכן בכל מחלוקת או הליכים משפטיים.

5.      החברה תוכל להשתמש בפרטיו האישיים של המזמין, ללא זיהוי המזמין הספציפי, לצורך ניתוח מידע סטטיסטי והצגתו ו/או מסירתו לגורמים אחרים.

6.      מאחר שמדובר בביצוע פעולות בסביבה מקוונת אין באפשרותה של החברה להבטיח חסינות מוחלטת מפני חדירות למחשביה או חשיפת המידע האגור בידי מבצעי פעולות בלתי חוקיות. אם יעלה בידי צד שלישי לחדור למידע אשר שמור בידי החברה ו/או להשתמש בו לרעה, לא תהיה למשתמש כל טענה, תביעה או דרישה כלפי החברה.

7.      החברה תהא רשאית לעשות שימוש ב – “עוגיות” (“cookies”) על מנת לספק למשתמש שירות מהיר ויעיל ולחסוך מהמזמין הצורך להזין את פרטיו האישיים בכל כניסה לאתר.

8.      בקיום מקרים שאינם בשליטתה של החברה ו/או הנובעים מכח עליון, החברה לא תהא אחראית לכל נזק מכל סוג שהוא, עקיף או ישיר, שייגרם למזמין ו/או למי מטעם המזמין עם מידע זה יאבד או אם יעשה בו שימוש לא מורשה.

11.   דין ושיפוט

1.      הדין החל על תקנון זה ו/או על כל פעולה ו/או על סכסוך הנובע ממנו, הוא הדין הישראלי בלבד.

2.      בכל מקרה של מחלוקת, תהא לבתי המשפט (השלום או המחוזי) תל אביב-יפו הסמכות הבלעדית לדון בה.

3.      הדין החל על השימוש באתר, על ההזמנה ועל תקנון זה, לרבות פרשנותו ואכיפתו של התקנון הוא הדין הישראלי בלבד.

ההנחיות ברמת WCAG 2.2 AA כוללות פרטים ספציפיים כיצד לפתח תוכן אינטרנט נגיש. הצהרה זו מאשרת כי טכניקות ספציפיות התקיימו עבור קריטריון ההצלחה המפורט על ידי WCAG. כתוצאה מכך התוכן שלך הפך לנגיש למגוון רחב יותר של אנשים עם מוגבלויות, כולל עיוורון וראייה לקויה, חירשות ואובדן שמיעה, לקויות למידה, מגבלות קוגניטיביות, מוגבלות בתנועה, לקויות דיבור, רגישות לאור ושילובים של אלה. על ידי יישום וציות להנחיות אלה, תוכן האינטרנט של האתר שלך הפך גם לשימוש יותר שמיש למשתמשים באופן כללי.

תאימות לדפדפנים וטכנולוגיה מסייעת

 

מטרת המשימה שלנו היא להיות מסוגלים לתמוך במגוון הרחב ביותר של דפדפנים וטכנולוגיות מסייעות ככל האפשר.

 

לכן השקענו מאמצים כדי לתמוך במערכות פופולריות בעלות נתח שוק גבוה, כולל Chrome, Firefox, Edge, Opera ו-Safari VoiceOver ב-MAC. התייחסנו גם לטכנולוגיות מסייעות של JAWS ו-NVDA עבור Windows ו-MAC.

שינויי נגישות

 

צוות המפתחים, המעצבים ומומחי הנגשת התוכן שלנו סקר, תיקן ובדק אתר זה על ידי ביצוע בדיקות נגישות רב-שכבתיות וניתוח של מדדי הנגישות החדשים והמעודכנים ותוכן האינטרנט. כחלק מהתהליך בוצעו התאמות שכללו עבודת Javascript ו-CSS. התהליך כולל גם שינויי נגישות לטכנולוגיות מסייעות (כגון NVDA, JAWS וכו'). להלן רשימה מלאה של שינויי נגישות ופונקציונליות שבוצעו.
